Walk Organiser Terms & Conditions

By participating in Heart Foundation Walking you agree to be bound by the Walk Organiser Terms and Conditions.

1.     I volunteer to act as a Walk Organiser and I accept all risks that may arise from my participation in HFW, including the risk of injury or loss of life.

2.     I have read and understood the Walker Handbook, the Walk Organiser Registration Form and the Walk Organiser Handbook prior to participating in HFW and will comply with the instructions contained in them.

3.     I declare that I am over 18, or that I am the parent and/or guardian of a Walk Organiser who is under 18. As a parent or legal guardian, I agree to these terms and conditions on behalf of my child.

4.     I agree to comply with all directions of the Heart Foundation.

5.     I will not conduct, organise, undertake or otherwise be involved in any activity that purports to be approved by or associated with HFW unless I have the Heart Foundation’s prior written approval to do so.

6.     I agree that if I walk with a pet, I will keep my pet under my control at all times and I accept all liability arising from my pet’s attendance at HFW.

7.     I release the Heart Foundation and all persons or corporations associated directly or indirectly with HFW from all known and unknown claims, liability, demands and proceedings arising due to any loss, damage, expense or personal injury which may be sustained by me as a result of or in connection with:

        a) any neglect, act, omission or failure on the part of the Heart Foundation
          (including its servants, agents, volunteers and employees) or any person or
          corporation associated directly or indirectly with HFW; or 

        b) my participation in HFW.

8.      I indemnify the Heart Foundation and all persons or corporations associated directly or indirectly with HFW (collectively “those indemnified”) against: 

          a) all losses incurred by those indemnified; 

         b) all liabilities incurred by those indemnified; and

         c) all costs actually payable by those indemnified to their legal representatives
           (whether or not under a costs agreement) and other expenses incurred by 
           those indemnified in connection with a demand, action, arbitration or other 
           proceeding (including mediation, compromise, out of court settlement or 
           appeal),

arising as a result of or in connection with my participation in the activities of HFW.

9.      I will not disclose or use participant’s personal information other than for the purposes of administering the Heart Foundation Walking program and not for any other personal, private or commercial use.  I will not act in a manner inconsistent with the Heart Foundation Privacy Notice available on the Heart Foundation’s website and as amended from time to time. 

10.    I will immediately cease to act as a Walk Organiser on receipt of written notice from the Heart Foundation.

11.    I will comply with these terms and conditions as may be amended by the Heart Foundation from time to time. I acknowledge that the Heart Foundation will display up to date terms and conditions at www.heartfoundation.org.au.

12.    I will provide true and correct information to the Heart Foundation and promptly notify the Heart Foundation of any changes to my information.

13.    I consent to the publication in any form of media of my name and details of my participation in HFW.  I understand that my contact information will be made publically available so that persons interested or involved in HFW can get in contact with me.

14.    I acknowledge that the Heart Foundation reserves the right, at its sole discretion, to exclude or reject me from participating in HFW at any time and without notice or explanation to me.

Defined Terms

In these Terms and Conditions:

a) Heart Foundation means the National Heart Foundation of Australia
(ABN 98 008 419 761) and each of its State and Territory divisions;

b) Heart Foundation Walking (HFW) means the Heart Foundation's programs to establish and promote participation in recreational walking groups;

c) Terms and Conditions means this document;

d) Walker means a person who participates or intends to participate in Heart Foundation Walking;

e) Walking Area Coordinator means the person appointed by the Heart Foundation to co-ordinate walking activities of HFW groups within their area; and

f) Walk Organiser or You means a Heart Foundation volunteer who manages and organises or intends to manage or organise a HFW group.
